TERMS AND CONDITIONS OF PURCHASE

These Terms and Conditions of Purchase govern the sale of frozen food products (fish, seafood and processed seafood products) by GRUPO SCAL – SOLUCIONES CONJUNTAS ALIMENTACIÓN, S.L. (hereinafter, “GRUPO SCAL”) to professional users only through the website https://scalhoreca.com (the “Website”).
1. Purpose and Scope
These Terms apply exclusively to business-to-business (B2B) transactions. GRUPO SCAL sells products solely to professional users, including wholesalers, distributors, restaurants, hospitality businesses and specialized food retailers.
Sales to private consumers, retail customers or for personal use are expressly excluded. Resale to third parties outside the professional activity of the User is prohibited.
By placing an order, the User declares that they are of legal age, have full legal capacity, and act on behalf of a business entity with authority to bind such entity under these Terms. Access to and use of the purchasing service is carried out at the User’s own responsibility.

These Terms are supplemented by the Legal Notice, Privacy Policy and Cookie Policy available on the Website. Use of the Website and placement of any order implies full acceptance of all applicable legal texts.
2. Products and Prices
The Website displays the essential characteristics of each product, available options, unit quantities, technical and nutritional information, and at least one representative image of the packaging. Images showing cooked or prepared products are for illustrative purposes only.
All information provided complies with applicable food information and traceability regulations.
Prices are indicated in euros (€) and exclude taxes. The applicable VAT rate (currently 10%) and any other applicable taxes will be displayed in the order summary prior to payment.
Once the delivery address is entered, any applicable shipping costs—borne by the User—will be shown.
Tax exclusions may apply in cases of legally exempt transactions or authorized international sales.
GRUPO SCAL reserves the right to update prices, modify promotions or withdraw products at any time. Such changes shall not affect orders already confirmed.
3. Purchase Procedure
Users may place orders either as guests or by creating an user account. Account registration requires, at minimum:
- Tax Identification Number (NIF / VAT number)
- Company name
- Email address
- Telephone (for delivery purposes)
- Password
Users undertake that all information provided is accurate, complete and truthful. Registration is free of charge and may be cancelled at any time.
To place an order, the User must select products and add them to the shopping cart. Before payment, the Website will display an order summary including product prices (VAT included), shipping costs and any applicable discounts.
Orders are processed once payment has been confirmed or validated. Available payment methods include:
- Credit or debit card
- Bizum
- Bank transfer
Payment data is processed using industry-standard security measures. GRUPO SCAL does not store users’ banking or card information.
Upon completion of the order, the User will receive an email confirmation with full order details. Any errors must be reported immediately via info@scalhoreca.com or by telephone at +34 986 95 89 24.
If a product becomes unavailable after order confirmation, GRUPO SCAL will contact the User to offer an equivalent product or issue a refund using the original payment method.
GRUPO SCAL reserves the right to cancel any order in the event of an obvious pricing, product description or typographical error. Any charges made will be promptly refunded.
4. Shipping Policy
Deliveries are made within mainland Spain and mainland Portugal using specialized cold-chain logistics providers. Deliveries are made at ground floor only. Users must provide a commercial delivery address suitable for refrigerated transport vehicles.
Shipping to the Balearic Islands, Canary Islands, Ceuta, Melilla, P.O. boxes or public delivery points is not available.

Orders cannot be modified once placed, unless expressly agreed and with shipping costs borne by the User.
Estimated delivery time is 48–72 business hours from dispatch. Delivery schedules may vary by location. Deliveries are not made on Saturdays, Sundays or public holidays.
GRUPO SCAL shall not be liable for delivery delays caused by force majeure, logistics disruptions or circumstances beyond its reasonable control.
Upon delivery, the User must immediately inspect the shipment. Any visible damage, quantity discrepancies or issues with packaging or product condition must be reported in writing to both the carrier and GRUPO SCAL as soon as possible.
Acceptance of delivery implies confirmation that the products were received in good condition. From that moment, the User assumes responsibility for proper storage, handling and use of the products. Products should be placed in a freezer immediately if not used at once.
No delivery claims will be accepted once the shipment is recorded as delivered and signed for.
5. Minimum Order and Shipping Costs
A minimum order of 35 kg applies for deliveries within mainland Spain and Portugal.
Shipping costs are calculated at checkout based on destination and order volume. The maximum shipping charge is €14.95. Orders exceeding 50 kg qualify for free shipping.

6. Claims, Incidents and Returns
GRUPO SCAL sells exclusively to professional users; therefore, consumer protection regulations do not apply.
In accordance with food safety regulations and by analogy with Article 103 of Spanish Royal Legislative Decree 1/2007, the right of withdrawal does not apply to frozen, refrigerated or perishable food products.
No returns are accepted due to change of mind.
Only claims related to:
- Mistaken products or quantities delivered
- Product defects
- Cold-chain breakage during transport
- Damaged or non-conforming products
will be processed.
Claims must be submitted in writing within 24 hours of delivery and must include clear photographs of the product and original packaging, along with a description of the issue.
If the claim is accepted, GRUPO SCAL may offer a refund (full or partial), replacement or substitute product at no additional cost.
Claims arising from improper handling, incorrect storage or causes beyond GRUPO SCAL’s control will not be accepted.
7. Data Protection
Personal data provided by Users will be processed in accordance with the Privacy Policy available on the Website.
8. Governing Law and Jurisdiction
These Terms and Conditions of Purchase shall be governed by Spanish law.
Any disputes arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the Courts of Vigo, Spain, unless mandatory law provides otherwise.
9. Amendments
GRUPO SCAL reserves the right to amend these Terms and Conditions of Purchase at any time. The current version shall always be available on the Website. Users are advised to review them prior to placing an order.
